Francis Nolberto, a 49-year-old man, will be spending his first night in prison tonight after being sentenced to more than 15 years for the sexual assault of a child. Nolberto, who was convicted on Thursday, November 6, before Justice Nigel Pilgrim, received his sentence today. His bail was previously revoked following his conviction. Justice Pilgrim sentenced Nolberto to serve 15 years, 11 months, and 20 days for the charge of sexual assault of a child under the age of 16 by penetration. He also received a concurrent sentence of 3 years, 11 months, and 20 days for the sexual assault of the child, who was six years old at the time of the offense. In determining the sentence, Justice Pilgrim considered several factors, including the aggravating factors of the offense, the aggravating and mitigating factors related to the offender, and powerful victim impact statements. The victim’s mother read a statement to the court detailing the profound impact the assault has had on their lives. She expressed overwhelming stress and guilt, stating, “Since April 2022 life for my daughter changed.” She shared that her daughter has become withdrawn and is “not been the same.” The mother further recounted the intimidation she faced after Nolberto was released from prison, forcing her and her daughter to relocate. This move caused them significant financial hardship and family division, leading her to feel she had “failed her daughter.” She concluded her statement by appealing to the court: “I pray you give him the maximum time in life he deserved.” Nolberto is now serving his sentence following the court’s decision.
