WAVE Radio may be having a déjà vu moment. About ten years after having to pay in a similar lawsuit brought by Troy Gabb, the station is facing another demand from him over allegations published on its Facebook page. Gabb Senior, through attorney William Lindo, is demanding that WAVE Radio and WAVE TV remove the post, issue a public apology and pay compensation. The letter, dated October 5, warns that court proceedings will follow if the station fails to respond. The dispute concerns an October 2 post titled “God Help the Public Service!” It criticised Gabb’s appointment to the Public Services Commission and questioned his record at the Development Finance Corporation and the Stake Bank project. His attorneys say a central allegation linking him to the release of a thirty-million-dollar loan to the Novelo group is false. According to the letter, that loan was approved and disbursed in April 2001, nearly six months before Gabb became DFC chief executive that September. They maintain that he had no role in approving or disbursing it. The letter also challenges the post’s references to Gabb being questioned in court and before a commission of inquiry. His attorneys say appearing as a witness does not amount to a finding of wrongdoing. In the Stake Bank litigation, they say Gabb was a witness, not a defendant, and no finding of wrongdoing was made against him. They also clarify that his appointment is to act as chairperson of the Public Services Commission during the substantive chairperson’s leave of absence, effective July 20. Gabb has demanded that the post be removed within forty-eight hours of the letter being received. He also wants an undertaking that the allegations will not be repeated, an apology on Facebook and on air, compensation and payment of his legal costs. The station has been given twenty-one clear days from receipt to formally respond. The letter says Gabb will consider an offer to make amends or mediation, but insists that the post’s removal should not be delayed.
